Statutory Mutual Transfer Rules & Seniority Protections
Bottom Seniority Rule (Para 226 IREC & Rule 38)
Under Railway Indian Railway Establishment Code (IREC) Rule 226 and Postal Rule 38, when two government servants seek mutual transfer, both step into bottom seniority of the seniority unit in the new division. You retain your past service length for pension and pay increments, but lose promotional seniority against locally recruited peers.
Identical Recruitment Cadre Mandatory
Mutual transfers are permitted strictly between candidates of the identical cadre, identical mode of recruitment (Direct Recruit vs Promotional), and identical or corresponding pay matrix level. A Level 2 ALP can only swap with another Level 2 ALP.
Irrevocable Consent Clause
As per Railway Board master circulars, once both employees sign the Joint Mutual Transfer application and the competent authority (DRM / Postmaster General) issues formal approval, neither party can unilaterally withdraw consent.
No Transfer TA / Composite Grant
Because mutual transfers are executed purely on the personal request of the government servant, no Composite Transfer Grant (CTG), joining time salary, or transit pass allowance is sanctioned by the department.
Mutual Transfer Official FAQ & Legal Guidelines
What is the difference between One-Way Request Transfer and Mutual Transfer?
In a One-Way Request Transfer, the employee waits in a seniority-based queue until a vacancy opens up in the target division, which often takes 5–10 years. In a Mutual Transfer, two employees of identical cadre swap places immediately upon administrative approval without waiting for vacancies, subject to both taking bottom seniority.
How does India Post Rule 38 Online Transfer Portal work?
The Department of Posts operates an online Rule 38 portal where candidates submit inter-circle and intra-circle mutual transfer requests. Direct recruit Postal Assistants and Sorting Assistants become eligible after 1 year of regular service (for female and PwD employees) or 2 years for other candidates.
What documents are required for a Mutual Transfer application?
Candidates require: (1) Joint Mutual Transfer Application in the prescribed format, (2) Service Book extract / Attested copy of Appointment Order, (3) Vigilance / Disciplinary Clearance Certificate (VCC), (4) Declaration agreeing to accept bottom seniority in the receiving division.
