Retirement Gratuity Calculation Principles:
- Qualifying Service: Minimum 5 years of continuous regular government service is mandatory to earn retirement gratuity.
- Multiplier: Granted at the rate of 1/4th of monthly emoluments (Last Basic Pay + DA) for each completed six-monthly period of qualifying service.
- Maximum Service Limit: Service beyond 33 years (66 semesters) is not counted, capping total gratuity at a maximum of 16.5 months' emoluments.
- Enhanced ₹25 Lakh Ceiling: In accordance with 7th Pay Commission recommendations, when Dearness Allowance breached 50%, the maximum ceiling on gratuity was raised by 25% from ₹20 Lakhs to ₹25 Lakhs.
- 100% Tax-Exempt: Fully exempt from income tax under Section 10(10)(i) of the Income Tax Act without any monetary limitation for government servants.
Frequently Asked Questions on Government Gratuity
How is a fraction of a year treated in calculating qualifying semesters?
Under CCS (Pension) Rules, a period of 3 months or more is treated as one completed six-month qualifying period (semester). A period of less than 3 months is ignored. For instance, 28 years and 4 months of service is reckoned as 57 completed six-month blocks (28 × 2 + 1).
Can government gratuity be withheld or attached for department dues?
Gratuity cannot be attached by any court decree. However, the government has a statutory right to recover outstanding government dues (such as license fee arrears for government quarters, unreturned advances, or loss caused to government through disciplinary proceedings) from the final gratuity payout under Rule 71 of CCS (Pension) Rules.
Is Dearness Allowance (DA) included in gratuity calculation?
Yes. Unlike earlier rules where only basic pay was considered, the 7th Pay Commission explicitly defines 'Emoluments' for the purpose of gratuity as Last Basic Pay plus Dearness Allowance (DA) applicable on the date of retirement or demise.
